More States To Withdraw from the ICC?

Shortly after three African States (Burundi, Gambia, and the Republic of South Africa) announced their intention to leave the International Criminal Court (each citing their own specific reasons), on November 16, the Russian Foreign Ministry issued a statement announcing its intention not to ratify the Rome Statute stating that

The ICC as the first permanent body of international criminal justice inspired high hopes of the international community in the fight against impunity in the context of common efforts to maintain international peace and security, to settle ongoing conflicts and to prevent new tensions. Unfortunately the Court failed to meet the expectations to become a truly independent, authoritative international tribunal.

The Russian President issued a Decree on the intention not to become party to the Rome Statue, becoming a fourth state to openly point out its disappointment with the institution.

On the same day,the High Commissioner for Human Rights, Zeid Ra’ad Al Hussein, in a press release called on the international community to not give up on the Court and to “stand by the Rome Statute and the Court.” He emphasized the need to stand with this institution and continue to support it.

To make matters worse, just one day after the Russian announcement, Philippine President Rodrigo Duterte, speaking from his home, also threatened to withdraw from the International Criminal Court by stating

They [Russians] may have thought the International Criminal Court is [useless], so they withdrew their membership … I might follow. Why? Because these shameless bullies only picked on small countries like us.

Some speculated that Duterte’s statement was nothing more than just a well-timed response to Prosecutor Bensouda’s statement on the situation in the Philippines, in which Bensouda made it very clear that anyone engaging in any form of acts of mass violence could potentially be prosecuted by the Court.

Whether in response to OTP’s statement or just in light of the exodus of State Parties from the ICC, Philippines is the fifth state, in a span of less than a month, to publicly disavow its loyalties to and faith in the Court and its effectiveness.  It will be interesting to see how the rest of the international community and the Court itself tackles these, hopefully, temporary setbacks.

Ukraine Expands Its Acceptance of ICC Jurisdiction

Violence in Ukraine has troubled that nation and the world community for about two years. Recently, Ukraine has renewed and expanded its efforts to afford the International Criminal Court jurisdiction to investigate and prosecute those responsible for mass crimes committed on its territory. Ukraine is now alleging that Russia is responsible, in part, for such crimes.

Ukraine is not a State Party to the ICC’s Rome Statute. However, as written about in April 2014 post, Ukraine lodged an Article 12(3) declaration, which allows a non-Party State to accept the Court’s jurisdiction over crimes within its subject matter jurisdiction that are committed on the State’s territory. Ukraine’s 2014 declaration alleged that crimes against humanity were committed during internal strife in Ukraine between November 2013 and February 2014, responsibility for which it alleged was attributable to Ukraine’s former President and possibly other senior officials in his government. The ICC Prosecutor has been conducting a preliminary investigation regarding this matter but has not yet decided whether to seek authorization to open a formal investigation that would expand her investigative powers and allow for filing of charges against individuals.

Ukraine has now gone further. In a September 8, 2015 press release the ICC reported that the ICC Registrar acknowledged receipt of a second Article 12(3) declaration by Ukraine, in which Ukraine expands its acceptance of ICC temporal jurisdiction from beyond February 2014 to the indefinite future. Importantly, the declaration attributes responsibility for post-February 2014 war crimes and crimes against humanity to “senior officials of the Russian Federation and leaders of terrorist organizations.” Thus, Ukraine’s second declaration opens a politically potent issue, asking the ICC Prosecutor to conduct at least a preliminary investigation into Russia’s alleged involvement in the violence in Ukraine.

In its September 8 press release, the ICC noted that “[t]he provisions of Part 9 of the Statute relating to international cooperation and judicial assistance apply.” Part 9 of the Rome Statute imposes on State Parties the responsibility “to cooperate fully with the Court in its investigation and prosecution of crimes within the jurisdiction of the Court.” The Russian Federation, however, is not a State Party to the Rome Statute, and thus has no such responsibility to the ICC.

It will be interesting to see how this matter will develop.

Reflections on a Criminal Justice Summer

It has been quite a summer. Having been involved in the criminal justice system for more than forty years, I feel as if there has never been a summer with so much going on – and so much attention being paid to it. Ferguson, Missouri, is the most recent and most alarming event, following so closely on the Staten Island chokehold case. These cases have focused serious attention on the police-citizen relationship that was front and center last year in the stop-and-frisk decision and the settlement of that lawsuit by the new New York City mayor.

We have been witness to the unprecedented actions of the Brooklyn, New York Conviction Integrity Unit in the District Attorney’s office, and to the dismissal of erroneous convictions in that county. These dismissals have been followed by substantial financial settlements by New York City. The New York Times ran a series of editorials urging the decriminalization of marijuana possession in some circumstances, and another editorial calling for revisions in the virtually-non-existent clemency process. Four state governors are either being tried, charged, or investigated.

Rampant prisoner abuse has been exposed just as claims made by prisoners has spiked, and there is now dialogue about the excessive use and destructive results of solitary confinement. The entire capital punishment process has come under scrutiny because the drug companies who provide the lethal drugs to accomplish our executions are no longer willing to do so. There is increasing focus on our entire system of punishment because of international attention on our disgracefully large prison population.

On an international level, we have also been witness to mass executions in Egypt and a long-awaited English investigation of the poisoning of a Russian journalist in London. Scotland abolished its long-standing and unique corroboration requirement. We were witness to an historic event:  a Black, South African, and female judge presiding at the trial of a young white male, who happened to be an internationally acclaimed athlete.

Having been raised on a September to September calendar, and having continued with that conception of the “year” as a law professor, I am pausing to wonder what we will witness in the next twelve months.

For now, the staff of the PCJI are taking a two-week break. We will resume our blog after Labor Day, on September 4.
